These Terms of Services (this “Agreement”) set out the terms and conditions on which we will provide you our Internet access service (the “Services”). For the purposes of this Agreement, “you” means the subscriber to the Services, and “we,” “us” or “our” means Lyte Fiber, LLC.

This page informs you of how Lyte Fiber, LLC (“us”, “we”, or “our”) collects, uses, discloses, and protects your Personal Information when you access or use our services, including when you sign up for, use, or communicate about any of our services (such as our internet fiber service) and when you visit our website (collectively, the “Services”).

We will not use or share your information with anyone except as described in this Privacy Policy. By accessing or using our Services, you agree to the collection, use, and disclosure of information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

Information Collection

In connection with taking orders and providing Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information (“Personal Information”) we may request may include, but is not limited to, name, email address, telephone number, and address. 

We also collect information that you choose to provide us. For instance: we may collect information related to how you use the Services as a part of our operation of the Services. This information may include, for example, network connection and performance information, websites and apps you visit and use, router connections, mobile and device numbers, domain name server information, service options you choose, usage statistics, dates and times of connection, and other similar information. 

We collect information that your browser sends whenever you visit our website (“Log Data”). We use your sensitive personal information only as reasonably necessary to provide the Services and in a manner limited to the business purpose for which the Sensitive Personal Information was collected. We may require certain sensitive personal information from you, including precise geolocation, drivers license, and racial or ethnic origin (“Sensitive Personal Information”) from you when using the Services, depending on the Services you request. We recognize that certain jurisdictions have enacted laws with different requirements regarding the processing of certain Sensitive Personal Information. In the cases where we do seek to collect Sensitive Personal Information, we will seek to do so in accordance with applicable data privacy laws. Do not provide us with unsolicited Sensitive Personal Information.

We may receive personal information about you from third-party sources such as marketing partners, social media and other cloud-based platforms, identity providers, publicly available sources, business partners, data providers, or third-party staffing or personnel providers. This Privacy Notice does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the website links. The inclusion of a link on the website does not imply endorsement of the linked site or service by us or by our affiliates. 

If you choose to apply to work with or for us through our website or by otherwise contacting us regarding opportunities to become an employee, agent, or contractor for us, we may collect the following:

  • Identification data, such as your name, date of birth, social security number, and other government identifiers.
  • Contact information, such as your first and last name, email and mailing addresses, phone number, emergency contact information, professional title or profession, and company name, if applicable.
  • Application information regarding qualifications, skills, employment or education history, or other related information provided voluntarily in response to questions and during any interviews.
  • Reference information, such as name and contact details of your references.
  • Social media information, such as if you provide us a link to or other access to a social media account, we may collect or access any information you permit to be shared through or from your social media account and other information depending on the social media platform.
  • Background check information, subject to applicable law.
  • Compensation information, such as financial account information, and any other compensation information that you voluntarily provide, which may depend on your region and applicable laws and regulations.

You are responsible for the accuracy of the personal information you provide or make available to us. Some information is provided directly to us for internal use, while other information may be shared directly with a service provider who handles specific aspects of our operations. Some information is mandatory to provide because it enables us to perform mandatory employee-hiring processes, like issuing your paycheck or verifying your eligibility for employment. All personal information you provide, particularly in connection with our recruiting activities, must be truthful, accurate and not misleading in any way. 

You may not provide us information that is obscene, defamatory, infringing, malicious, or that violates any law. If you provide personal information of a third party, you are responsible for providing any notices and obtaining any consents necessary for us to collect and use such personal information as described in this Privacy Policy. Please be careful before including any information in a public forum, discussion, or other space within the Site or Services.

Information Use

We use the information we collect from and about you as described above in accordance with applicable law for the following purposes: to provide and improve our Services; for sales, installation, operation, administration, support, network management, maintenance, customer service, communications with you, billing, and collection; to market our Services to you, including through targeted advertisements; to detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal or a threat to safety; for HR purposes (to the extent you have applied for a position with us); and to assist law enforcement and comply with legal requirements. We do not use information about your browsing habits (e.g., sites you visit or apps you use) or your other use of the Services for marketing the products of third parties. We may combine information from the Services with other information we obtain from our business records, our affiliates, or third-party services. We may aggregate and/or deidentify any information collected through the Services so that the information can no longer be linked to you or your device. We may use the aggregated and/or deidentified information for any purpose, including without limitation for research purposes and to promote our products and Services.

Information Disclosure

We may disclose the information collected from and about you as follows, subject to applicable law: (1) with your consent; (2) to our service providers, which may use it only on our behalf, at our direction, and for a purpose for which we may use the information; (3) to comply with a legal requirement; (4) if we believe that there has been fraud, abuse, a violation of our or third party’s rights, or a violation of our Terms of Service, including our Acceptable Use Policy; (4) to respond to judicial process, governmental investigations, and provide information to law enforcement agencies or in connection with an investigation on matters related to national security, public safety, or otherwise as required by law; (5) in an emergency to protect your safety or that of others; and (6) as disclosed to you at the point of collection. We do not sell your Personal Information. If Lyte Fiber is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.

Data Retention

Lyte Fiber maintains information that personally identifies you in our regular business records while you subscribe to our Services. We also maintain this information for a period of time after you no longer subscribe to a Service if the information is necessary for the purposes for which it was collected or to satisfy legal requirements. These purposes typically include business, legal, or tax purposes. If these purposes no longer apply, we will destroy, de-identify, or anonymize the information according to our internal policies and procedures.

Security

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we use commercially reasonable means to protect your Personal Information, we cannot guarantee its absolute security.

Our Services may contain links to other websites, platforms, services, and applications that are not operated by us. If you click on a third-party link, you will be directed to that third party’s website, platform, service, or application. We strongly advise you to review the Privacy Policy of every website, platform, service, and application you visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites, platforms, services, or applications.

Children’s Privacy

We do not offer our Services to anyone under the age of 13 (“Children”).

We do not knowingly collect Personal Information from Children. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we discover that a child 13 or under has provided us with Personal Information, we will promptly work to delete such information from our servers.

Opting Out of Certain Marketing Communication and Other Rights

You may choose to opt out of marketing emails and newsletters by selecting the Unsubscribe button at the bottom of our emails. You must reach out to Lyte Fiber to be added back into any marketing communications.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the date at the top of the page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. Your continued use of the Services will be deemed acceptance of our Privacy Policy.
